Chloe Apter is a member of the Construction Defect Litigation department of Berding|Weil. Ms. Ms. Apter has extensive experience handling real estate, commercial litigation, complex construction defect, and class action lawsuits throughout California. Her practice includes all phases of litigation, from inception through appeal, and she possesses a rare and balanced perspective, having worked for both defense and plaintiff firms in her litigation career.
Ms. Apter represents a wide variety of clients, including condominiums, planned developments, over fifty-five active adult communities, mixed- use projects, and all manners of common interest developments. She also has experience providing corporate counsel to Boards on community governance, policy adoptions, governing document amendments, special and emergency assessments, enforcement matters, and all manners of issues.
In addition to litigating myriad construction defect claims, during her time at Berding|Weil, Ms. Apter has handled many complicated and less familiar matters. In one example, she defended her client, a homeowners association, regarding its right to make real property improvements to yard areas owned by separate interest owner defendants, but maintained by the association. Defendants filed an anti-SLAPP motion in response to the complaint, which Ms. Apter helped successfully oppose at the trial court level. Defendants thereafter appealed the trial courts decision and Ms. Apter again prevailed on her clients behalf in the Court of Appeal.
Another time, Ms. Apter successfully negotiated an early settlement in the pleading stage for her client, a commercial landowner, regarding alleged violations of the Americans with Disabilities Act (ADA) and California Unruh Act, saving her client hundreds of thousands of dollars in legal fees and costs defending the lawsuit.
Prior to joining Berding|Weil, Ms. Apters practice focused on general liability litigation, representing commercial and residential property owners, contractors and product manufacturers in matters relating to defective construction, personal injury, insurance, business and products liability.
Ms. Apter is licensed to practice in the Superior Court of California as well as United States District Court for the Northern and Central Districts of California.
Ms. Apter received her Juris Doctor from Santa Clara University School of Law in 2011. During law school, she was an editor for the Santa Clara Law Review. Ms. Apter received her Bachelor of Arts in Philosophy, graduating early and magna cum laude from the University of San Diego in 2008.
